Terms of Service

These Terms of Service ("Terms") govern your access to and use of (a) the website at https://foxinthebox.io/ (the "Site"); (b) Fox in the box software, documentation, and related materials; (c) any cloud-hosted access to Fox in the box that we operate for you to use without downloading; and (d) any LLM gateway or related API we offer that routes your requests to third-party language model providers (an "LLM Gateway," similar in purpose to aggregator-style services such as OpenRouter) (collectively with the Site, the "Materials"). The Materials are provided by Vulpy, Inc. ("Vulpy," "we," "us," or "our"), a Delaware corporation with its principal business address at 8 The Green, Ste D, Dover, DE 19901, United States. By accessing or using the Materials, you agree to these Terms. If you do not agree, do not use the Materials.

Effective date: May 2, 2026. We may change these Terms at any time. We will post the updated Terms on the Site and revise the effective date. Your continued use after the effective date of changes constitutes acceptance of the revised Terms, except where applicable law requires a different process.

Fox in the box is software that runs a Docker container inside an Electron application. The project is released under the MIT License (or as otherwise stated in the repository you obtain it from). The Software incorporates or depends on third-party open source and other third-party components, each under its own license. Nothing in these Terms restricts your rights under the MIT License for the portions of the Software licensed to you under MIT; where these Terms conflict with the MIT License for those portions, the MIT License controls for those portions.

We may make Fox in the box available for download and local or self-hosted use, for use in the cloud on infrastructure we operate, or both, depending on what we offer on the Site, in product flows, or at checkout. Packaging, features, and availability may differ between downloadable and cloud offerings.

If we provide an LLM Gateway, it acts as an intermediary that forwards compatible requests to third-party model providers you select or configure. Those providers—not Vulpy—supply the models and may process prompts, outputs, and related technical data under their own terms and privacy notices. You are solely responsible for your prompts and use of model outputs, for complying with each provider's rules and acceptable use policies, and for ensuring your use complies with applicable law (including export, privacy, and intellectual property law). Artificial intelligence outputs can be incorrect, incomplete, or biased; we do not verify or endorse them.

We do not warrant that any third-party component or model provider is error-free, secure, maintained, or fit for any purpose. You are responsible for reviewing and complying with all applicable third-party licenses, notices, and attribution requirements.

Subject to these Terms and applicable law, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Site and to use the Materials only for lawful purposes and in accordance with any technical documentation we provide. You may not use the Materials in any way that violates law, infringes others' rights, or interferes with the Site or others' use of it. Without limiting the foregoing, you may not attempt to gain unauthorized access to our or others' systems, distribute malware, scrape the Site in a manner that overloads our infrastructure, or misrepresent your affiliation with Vulpy.

You are solely responsible for your environment, configuration, data, networks, credentials, and how you build, run, distribute, or modify the Software (including any Docker images, containers, Electron builds, or forks). You assume all risk arising from such activities.

If you purchase paid access to any Materials (for example, cloud use or LLM Gateway usage), fees, billing cycles, and taxes will be as shown at checkout or in a separate order flow. Except where a refund is required by applicable law, all fees are final and non-refundable. Unused usage, partial periods, cancellations, or failure to use the Materials does not entitle you to a refund or credit.

We do not commit to any uptime, availability, latency, throughput, error rate, or support response time. There is no service level agreement (SLA), and we do not offer service credits for downtime, degradation, maintenance, security incidents, or third-party outages (including model providers). The Materials may change, be limited, or be discontinued at any time.

THE MATERIALS ARE PROVIDED FOR GENERAL INFORMATION AND ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. WITHOUT LIMITING THE FOREGOING, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE MATERIALS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING MODEL OUTPUTS, ACCURACY, OR FITNESS FOR A HIGH-RISK OR REGULATED USE CASE. NOTHING ON THE SITE CONSTITUTES LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL VULPY OR ITS AFFILIATES, LICENSORS, SUPPLIERS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE MATERIALS OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE MATERIALS OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO VULPY FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US$50), IF YOU HAVE NOT PAID US ANY FEES. THESE LIMITATIONS APPLY WHETHER THE THEORY IS WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Vulpy and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Materials (including prompts, outputs, and data you send through an LLM Gateway), your violation of these Terms, your violation of law, or your violation of any third-party rights.

We may suspend or discontinue the Site or any Materials, or restrict access, at any time without liability. We are under no obligation to provide support, updates, bug fixes, or continued availability of any repository, binary, cloud deployment, LLM Gateway route, or feature.

The Site may link to third-party sites or services. We do not control and are not responsible for third-party content, terms, or privacy practices.

These Terms and any dispute arising out of or related to the Materials or these Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules, and the federal laws of the United States where applicable, without regard to the United Nations Convention on Contracts for the International Sale of Goods. Subject to mandatory consumer protections that may apply in your jurisdiction and cannot be waived, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for any disputes not subject to mandatory arbitration or other required forum.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms constitute the entire agreement between you and Vulpy regarding the Materials and supersede prior agreements on the subject.
